1. Introduction

Bahay Turo Technologies Inc.(“Bahay Turo,” “we,” “us,” or “our”) owns www.bahayturo.com and any and all associated domains and websites (collectively, “Site”).  The Site is an online platform designed to help parents or guardians and students connect to, and book the services of, highly-ranked teachers for their children and other services related thereto (collectively, the “Services”).

We commit to the protection of your Personal Information provided and shared on the Site and those that were provided to us directly. We have developed this Privacy Policy to provide information about our privacy practices and to comply with the requirements of applicable privacy laws, particularly, Republic Act No. 10173, also known as the Data Privacy Act of 2012 (“Data Privacy Act”) and its implementing rules and regulations.

This Privacy Policy applies to all users and visitors who access, use, and interact with the Site and/or Services (collectively, “you,” or “your”) and describes what, how, and when we collect, use, disclose, and safeguard your information.

“Personal Information” is any information from which your identity is apparent or can reasonably and directly be ascertained by the holder of the information, or when put together with other information would directly and certainly identify you.  This includes, but is not limited to, your name, telephone or mobile number, bank and credit card details, email address, your image, government-issued identification numbers, date of birth, employment information, and school information.

Please read this Privacy Policy carefully before using the Site and Services. By accessing, using, and interacting with the Site and Services, you agree to and accept this Privacy Policy. This Privacy Policy is incorporated into the Terms of Use, both for Teachers and Parents, for this Site. Any reference to the Site in this Privacy Policy shall also mean the Services and other features, and content offered on or through the Site.

2. Information We Collect

Information You Provide Us

We collect Personal Information from you when you use our Site. We do not collect any Personal Information unless you voluntarily provide it to us. Such information includes:

Account Information. We may collect your Personal Information when you register or create an account on our Site, including your full name, email address, password, phone or mobile number, birthdate, location or address, education, photo, and other account information. For teachers, we may collect additional Personal Information to assess your eligibility to provide the Teaching Services (as defined in the Terms of Use for Teachers), such as, but not limited to, academic records, work experience, character reference/s, training certificates, government-issued IDs, certifications, paid demo teaching, and diploma. For parents and guardians, we collect information about your child/children or ward/s, including their full names, ages, schools, and birthdates. 

In certain circumstances, you may need to provide your Personal Information in order to comply with legal requirements or contractual obligations, or where it is necessary to conclude a contract.  Failure to provide such Personal Information, under such circumstance, may constitute failure to comply with legal requirements or contractual obligations, or inability to conclude a contract with you, as the case may be.

For purposes such as protecting vitally important interests of users of the Site, especially the minor students, we may also collect Personal Information without consent, by relying on exemptions provided by the Data Privacy Act.

When you use the Site, you may choose to disclose and display certain information to, and communicate, interact, and transact with, other users on Site. You will also have access to information disclosed and displayed by other users on Site. For teachers, you need to create a profile that will be publicly available. These include your username, phone number, photo, work experience, interests and preferences.

Payment Information. We may collect your financial and billing information, such as your credit or debit card information, directly or through a third-party vendor, to be used for transactions initiated and made on the Site. For teachers, we may also collect your bank account information and tax identification number to facilitate payment of fees that we collect on your behalf.

The credits that can be used in the Site can be purchased using PayPal. You will provide your credit or debit card number directly to PayPal. PayPal’s privacy policy will apply to the information you provide on the PayPal Website.

Communications with us. When you contact us or communicate with us through the Site, email, phone, social media platforms, or other methods of inquiry or communication, we collect information you provide in your communications, including feedback, ratings, and complaints. We use this information to fulfill and/or respond to your communications and requests, keep you informed about the Site, and to optimize the Site.

Communications with other users. The Site allows users to communicate with each other. Interaction may be in a form of one-on-one communication via video or chat feature, which may be recorded and stored in our servers for future reference.

Bahay Turo does not have access to information collected outside the Site when teachers and parents, guardians or students communicate outside the Site.  The responsibility for such information belongs to either the teacher or parent, guardian or student. 

Other Information. You may choose to provide us other information when using the Site, including your lesson requests, response to surveys or questionnaires provided by us, testimonials, and ratings of other users you interact with on the Site.

By providing this information, you do so at your own discretion and risk and authorize us to collect, use, disclose, and store the information in accordance with this Privacy Policy and applicable law. While you may be able to use the Site anonymously on a limited basis and choose not to provide us with Personal Information, this will prevent you from using the Site fully and functionally.

Information We Automatically Collect

We may automatically collect certain information whenever you use the Site or interact with us, including:

Usage Information. We collect information about your use of the Site, such as the date you created an account on Site, the date(s) and time(s) you use the Site, the length of time that you spend on Site, actions you take on Site, [including lessons that you’ve started and completed], actions you take on emails we sent related to the Site and/or Services, and the pages or content you view on, before, or after Site, including links to third-party websites and applications.

Log Data. We may maintain web server logs and automatically collect log information and logging actions when you use the Site, even if you do not have an account with us. Log data includes internet protocol (IP) addresses, geolocation, hardware and software information, device information, operating system, browser type, device event information (e.g., crashes), and internet service provider or mobile carrier. Log data may be purged periodically at any time.

Transaction Information. We collect information related to your payments and transactions on Site, including the date and time of transactions, amounts charged, cancelled payments, and other related details.

Cookies. We may use cookies, for example, to keep track of your preferences and profile information. Cookies are also used to collect general usage and volume statistical information that does not include personal information. Most browsers allow you to block and delete cookies. However, if you do that, the Site may not work properly.

3. Use of Information We Collect

We may use, combine and process the Personal Information we collect for internal use in accordance with this Privacy Policy, our Terms of Use, and applicable law, including:

  • To provide services to you through the Site and process transactions, billing, and payment;

  • For identification and authentication purposes;

  • Screening teachers before allowing them to provide Teaching Services;

  • For research and development to personalize and improve the Site, and the Services and other features and content we provide through the Site, and to enhance the user experience, including researching user demographics and behavior;

  • To respond to your requests, inquiries, and complaints, provide you with technical and customer support, and solicit and receive feedback from you related to your use of the Site;

  • For standard business practices and purposes including system administration, troubleshooting, establishing and managing accounts, creating and maintaining a database of information collected on the Site;

  • To safeguard, deter, and investigate against illegal, fraudulent, or unauthorized use of the Site;

  • To verify compliance with this Privacy Policy, our Terms of Use, any agreements entered into between you and us, and applicable law;

  • To investigate and resolve claims or disputes, or as allowed or required by applicable law;

  • To comply with our obligations under the Terms of Use and any agreements entered into between you and us and enforce our Terms of Use or other agreements;

  • To protect our rights or property in the event of a claim or dispute;

  • To contact you directly for non-marketing purposes including providing you with statements, receipts, confirmations, notifications, surveys, technical updates, security alerts, and administrative messages; and

  • To contact you directly for marketing purposes, including carrying out market surveys and polls, delivered by Bahay Turo, through automated systems, such as email, sms, or messaging applications, of personalized marketing material on the products and services offered by Bahay Turo and/or by Bahay Turo’s partners.

You may opt out of the processing of your Personal Information for marketing purposes by not ticking the checkbox on the Site or by clicking on the unsubscribe link in the relevant email or message.

You acknowledge and agree that all non-personally identifiable information or data, such as requests, comments, suggestions, and feedback, that are provided to us in any manner by you is non-confidential. To the extent permitted by applicable law, you grant us, or anyone authorized by us, a non-exclusive, unrestricted, irrevocable, perpetual, royalty-free, and worldwide license to use, distribute, display, modify, reproduce, transmit, perform, and broadcast derivative works of such information or data, in whole or in part, and in any manner or medium, at no cost whatsoever.

4. Disclosure of Information to Third Parties

We do not allow third parties to collect your Personal Information. However, we reserve the right to disclose certain information to third parties in limited circumstances, at our sole discretion and without further notice to you, if it is deemed necessary and in accordance with this Privacy Policy, our Terms of Use, and applicable law, including the following circumstances:

  • We may provide Personal Information to teachers in order for them to perform the Teaching Services and to parents or guardians or students in relation to the provision of the Teaching Services;

  • We may provide Personal Information to our vendors, consultants, marketing partners, and other service providers or business partners, such as, cloud storage providers and payment processors and facilitators;

  • As required by law, such as to comply with a subpoena or court order, or in connection with any ongoing or prospective legal proceedings;

  • When we believe in good faith that disclosure is necessary to enforce our rights, protect your safety or the safety of others, and safeguard, deter, and investigate against illegal, fraudulent, or unauthorized use of the Site;

  • If we or all or a portion of our business is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation;

  • With your express written consent; and

  • As otherwise described or permitted in this Privacy Policy, our Terms of Use, and applicable law.

If any personal information is disclosed to a third party, the third party shall maintain the confidentiality of such information and is prohibited from using it for any purpose except as permitted by us and in accordance with this Privacy Policy.

5. Children’s Information

We do not ask children under the age of 18 to provide their Personal Information. Parents or legal guardians must provide their full consent for the collection, use, sharing, and disclosure of a child’s personal information. We will not collect, use, or disclose any Personal Information from a child if his/her parents or legal guardian does not provide such consent.  If you are not the parent or legal guardian of the child, you warrant that you have obtained the consent of the parent or legal guardian of the child for the latter’s Personal Information to be collected, used, and disclosed as set out in this Privacy Policy.

6. Security

We implement physical and technical security measures commercially reasonable and necessary to protect the information we collect from you from unauthorized access, use, alteration, disclosure, or destruction of such information. This includes measures to prevent Personal Information from getting lost, used or accessed in an unauthorized way.  We limit access to your Personal Information to our employees on a need to know basis.  Those processing your Personal Information only do so in an authorized manner and are required to treat your Personal Information with confidentiality.  However, we cannot guarantee these safeguards are absolutely secure and that any Personal Information will remain free from unauthorized access, misuse, alteration, disclosure, or destruction by third parties. Should we learn of a potential or actual security breach that puts your Personal Information at risk of unauthorized access, use, alteration, disclosure, or destruction, we may notify you so you can take appropriate next steps to protect and remedy the situation. However, we are not liable or responsible for any of your Personal Information that is intercepted and used by an unintended third-party recipient.

7. Data Retention

We will retain your information for as long as your account is active, for a commercially reasonable time determined by us for administrative, liability, and archival purposes, or to comply with our legal obligations, resolve disputes, and enforce our agreements.

If you have not used the Site or have not communicated with us for more than 3 years from your last log-in, and there are no pending disputes in relation to the enforcement of our agreements, then all information will be securely removed from our database.

8. User Rights

You have the right to access, modify, retract and/or delete any voluntarily submitted information by logging into your account settings on the Site or by contacting us directly as specified below in this Privacy Policy. We will do our best to properly respond, update, discard, and/or destroy such information pursuant to your request unless otherwise provided in this Privacy Policy, our Terms of Use, or by applicable law. You acknowledge that certain information is required for continued use of the Site and retracting or deleting certain information may prevent you from being able to use the Site and its services, features, and content. Please note that we may require you to prove your identity to fulfill such request.

9. Privacy Policy Updates

We reserve the right to update this Privacy Policy at any time, at our sole discretion and without further notice to you, from time to time. Updates to this Privacy Policy will be posted on the Site and go into effect on its specified effective date. Please check Site periodically when using the Site to keep up-to-date on any changes to this Privacy Policy. Your continued use of the Site constitutes your acknowledgment and acceptance of this Privacy Policy and any updates made to it. If you do not agree with any of the current or future provisions of this Privacy Policy, you shall not use, or continue to use, the Site.

10. Terms of Use

Any dispute between you and us regarding the privacy of your Personal Information is subject to this Privacy Policy and our Terms of Use, including limitation on damages, dispute resolution, and applicable law.

We cannot guarantee receipt of any correspondence, including mail, messages, and emails, sent to us; thus, receipt of any correspondence is not confirmed until and unless you receive a written response from a Bahay Turo representative confirming such receipt. We are not liable for any correspondence that is lost, delayed, or misdirected.
